Terms and Conditions
- The promoter is Sportsbet Pty Ltd ABN 87 088 326 612, a company incorporated in Australia under the Corporations Act 2001 (Cth), trading as ‘Sportsbet.com.au’ (“Promoter”).
- This competition (“Competition”) starts at 9:00am (AEST) on Wednesday 9 June 2021 and ends when all Microshares in the Racehorses have been given by the Promoter to Prize Winners or 30 June 2021
whichever is the earlier (“Competition Period”). - The Promoter is conducting the Competition in collaboration with MyRacehorse Pty Ltd ACN 643 461 590, a company incorporated in Australia under the Corporations Act 2001 (Cth), trading as ‘MyRacehorse’ (“MRH”).
- Information on how to enter and the prizes forms part of these terms and conditions (“Terms”). Participation in this Competition is deemed acceptance of these Terms.
- This Competition is open to all entrants who:
- are 18 years of age or over;
- are Australian residents;
- have a Sportsbet account and the account is not at any time during the Competition Period closed or suspended, and were the direct recipient of the Sportsbet email promoting the Competition (“Competition Email”);
- comply with these Terms; and
- are not management, employees or agents of the Promoter or its related entities (or immediate family members of such people) or of retailers or agencies associated with this Competition, (“Eligible Entrants”).
- To enter, an Eligible Entrant must follow the link in the Competition Email to the MRH website and correctly sign up and register for a MRH account (subject to the MRH terms and conditions which are available at https://myracehorse.com/au/terms-policy/) (“MRH Account”) during the Competition Period (“Entry”).
- The Promotion is a game of skill, and chance plays no part in determining the winner.
- Eligible Entrants will be limited to one Entry during the Competition Period. If an Eligible Entrant wants to make a new Entry the original Entry must be edited (by the Eligible Entrant). If there is more than one Entry from an Eligible Entrant, the earliest in time Entry will be the only Entry considered.
- Entries will be deemed to be accepted at the time as when an Eligible Entrant receives their automated confirmation email.
- You must ensure that your Entry does not include anything which:
- is or may be offensive, controversial, illegal, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, unsuitable for children aged under 18 or otherwise unsuitable for publication;
- may infringe the privacy, intellectual property or other rights of any person; or
- is likely to or may embarrass any individual or body or bring the Promoter into disrepute.
- The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected Entries.
- The Promoter reserves the right, at its sole and absolute discretion, to deem any irregular, incomprehensible and incomplete Entries or any Entriesthat do not comply with these Terms, asinvalid (“Invalid Entries”).
- Invalid Entries cannot win a prize in connection with the Competition.
- The Competition will be conducted as follows:
- My Racehorse No. 1 ARSN 646 771 262 (Scheme) (of which MRH is a duly authorised representative) owns 60% of the racehorse named Rock Chant and 20% of the racehorse named Inclement (together, the “Racehorses”);
- the Promoter is the owner if 1,000 Microshares in each of Rock Chant and Inclement (each representing 0.01% of the Scheme’s ownership of each Racehorse). “Microshare” means a Class A or Class B unit in the Scheme. For more detail about the Scheme and ownership structure of the Racehorses, please refer to the relevant Product Disclosure Statement available for Rock Chant (available at: https://cdnb.myracehorse.com/wp-content/uploads/2021/05/PDS offering-A-Class-Units-Rock-Chant-issued-26-May-2021.pdf ) and Inclement (available at:
- the Promoter reserves the right to cancel or change the Competition at any time throughout the Competition Period without notice;
- the decisions of the Promoter are final. No correspondence will be entered into;
- the Promoter reserves the right, at any time, to verify the validity of Entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an Entry that is not in accordance with these Terms or who tampers with the entry process;
- there will be a maximum of 2,000 Prizes given as part of this Competition;
- the total prize pool is valued at a maximum of $210,000. If the Prizes are unavailable, the Promoter reserves the right to substitute it with a prize of equal or similar value and/or specification, subject to any written directions from a regulatory authority;
- failure by the Promoter to enforce any of their rights does not constitute a waiver of those rights.
- by entering the Competition, all Entrants consent to the use by the Promoter their mobile number, email and uploaded content for Competition purposes;
- by entering the Competition, all Entrants consent to the use by the Promoter of their name, image, likeness, username and social network account name and Entry for publicity and commercial purposes in connection with the Competition and/or the Promoter’s products and services, in any media and for an infinite period, without further compensation. This includes but is not limited to use on TV, Facebook, Twitter, Instagram, YouTube, radio, print, display advertising, website and social media channels, and the Promoter’s blog and website;
- entry to the Competition is free, but entrants are responsible for any costs imposed by their internet service or other technology providers.
- the Promoter may prohibit any person’s participation in this Competition, cancel or suspend the Prize (or part thereof) if the Promoter considers that the Entrant has behaved in a way which may diminish its name or reputation, is in bad faith, is designed to gain an unfair advantage, is fraudulent, is otherwise contrary to law or these Terms, or is otherwise inappropriate;
- errors and omissions may be accepted at the Promoter’s discretion;
- the Promoter accepts no responsibility for any tax implications that may arise from the Prize. Independent financial advice should be sought. Where the operation of this Competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values;
- if this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the Promoter’s control, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, to the fullest extent permitted by law:
- to disqualify any Entrant; and/or
- subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition;
- the Promoter may collect personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use entrants’ information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to Entrants. Entrants should direct any request to opt out, access, update or correct information to the Promoter at customerservice@sportsbet.com.au. All personal information collected will be collected and held in accordance with Sportsbet’s Privacy Policy; and
- to the fullest extent permitted by law, the Promoter (and the prize suppliers) will not be liable for any loss or damage an Entrant or Prize Winner suffers as a result of participating in this Competition (including the Prize), unless caused by the Promoter’s negligence or wilful misconduct.
